Divine 360 LLC · New York City

Rental Agreement

Effective for all bookings · Last updated June 2026

This Rental Agreement ("Agreement") is entered into between Divine 360 LLC ("Company") and the client ("Client") upon submission of a booking and deposit payment. By completing checkout, the Client acknowledges and agrees to all terms outlined below. A second signature will be collected in person at the time of delivery.

Section 1

Booking & Deposit

A 30% non-refundable deposit is required at the time of booking to secure the event date. The deposit is applied toward the total rental cost. Dates are not held without a paid deposit. Booking is not confirmed until deposit payment is successfully processed.

Section 2

Balance Due at Delivery

The remaining balance (total minus deposit) is due in full at the time of equipment delivery. Accepted payment methods will be confirmed at booking. Failure to tender the remaining balance at delivery may result in refusal of service and forfeiture of deposit.

Section 3

Cancellation & Rescheduling

Cancellations made more than 48 hours before the event start time may be rescheduled to a future available date, subject to availability. The deposit is credited toward the rescheduled booking.

Cancellations made within 48 hours of the event start time will result in forfeiture of the deposit. No refunds are issued for cancellations within 48 hours, no-shows, or same-day cancellations. Rescheduling within 48 hours is at the Company's sole discretion.

Section 4

Rental Period

The rental period begins at the agreed start time and ends at the agreed pickup time as confirmed at booking. Setup and breakdown are performed by the Company and are not included in the quoted rental hours. The Client is responsible for being available and ready at the agreed start time.

Section 5

Late Returns & Unauthorized Extensions

Extensions beyond the agreed pickup time must be arranged and invoiced in advance. Unauthorized extensions — where the Client retains equipment beyond the agreed pickup time without prior approval — are billed at the applicable hourly rate plus a $50 late fee per hour. The Company reserves the right to retrieve equipment at the agreed pickup time regardless of event status.

Section 6

Equipment Responsibility

The Client assumes full responsibility for all Divine 360 LLC equipment from the moment of delivery until pickup. This includes the 360 booth, arm, platform, LED lighting, and any additional rental items delivered. Equipment must be kept in a secure, dry, indoor location and protected from unauthorized use, liquids, and weather conditions.

The Client is responsible for ensuring reasonable supervision of equipment use by guests throughout the event.

Section 7

Equipment Value & Damage

The total estimated replacement value of standard equipment is $1,500. The Client is liable for the full cost of repair or replacement for any damage caused by misuse, negligence, improper supervision, or guest interference during the rental period. Damage will be assessed at pickup. Charges in excess of the security hold will be invoiced separately and are due within 7 days of the event.

Section 8

Security Hold

A $150 security hold will be authorized on the Client's card on the morning of the event. This is a temporary authorization — not a charge — and does not reduce available card funds permanently. The hold will be fully released within 5–7 business days after the event, provided all equipment is returned in its original condition.

If damage is assessed at pickup, the Company reserves the right to capture all or part of the security hold to offset repair or replacement costs. Any amounts exceeding the hold will be invoiced separately.

⚡ The security hold authorization email will be sent at 8:00 AM on the day of your event. Client must authorize the hold before delivery proceeds.

Section 9

Photo ID Requirement

Valid government-issued photo ID is required at the time of delivery — no exceptions.

⚠️ No ID = No equipment. No exceptions. Failure to present valid ID at delivery will result in refusal of service and forfeiture of the deposit.

Acceptable forms of ID: driver's license, state-issued ID, or passport. The ID must belong to the booking party. Event planners booking on behalf of clients must present their own ID.

Section 10

Self-Service Terms & Booth Attendant

Divine 360 operates on a self-service model. Unless a Booth Attendant add-on is explicitly included in the booking, no Company representative will remain on-site after setup. The Client and guests are responsible for operating the equipment independently following the orientation provided at delivery.

A Booth Attendant may be added at booking for an additional fee based on event duration. Attendant availability is subject to scheduling and is not guaranteed unless confirmed at booking. The attendant's role is to assist guests with booth operation — not to manage the event.

Section 11

Overnight Rentals

Rentals exceeding 6 hours in duration, or spanning midnight, are classified as overnight rentals. Overnight pricing applies to non-booth items (Flower Wall, Giant Jenga, Giant Connect Four, Bar Cart) and is displayed at booking. Overnight rates are confirmed in the booking confirmation email. The 360 Booth is priced by hourly duration regardless of overnight status.

Section 12

Outdoor Rentals & Venue Liability

Outdoor use of equipment is permitted only in fair weather conditions with a covered or shaded area. The Company does not operate in rain, high winds, or extreme weather. A covered outdoor space is strongly recommended for any outdoor booking.

The Client is solely responsible for obtaining any necessary permits, permissions, or venue approvals for outdoor use. The Company assumes no liability for damage to venues, grounds, or third-party property resulting from outdoor equipment placement or guest use.

Section 13

Photo Keychain Services

When the Photo Keychain add-on is included, the Company will provide on-site live photo printing. Each guest receives a custom 2×3 photo sealed in an acrylic keychain. The quantity tier (Small: 25, Medium: 50, Large: 100 keychains) is selected at booking and is non-transferable to other services.

A Keychain Attendant is required for on-site printing and is included in the keychain pricing unless explicitly waived by the Client at booking. The Company does not guarantee that all booked quantities will be used — unused keychains are not credited or refunded.

The Client is responsible for ensuring a suitable table and power source are available for keychain printing setup.

Section 14

Media Delivery, Content Use & Deletion

For bookings that include a Custom Overlay add-on, edited videos will be delivered to the Client within 48 hours after the event via the Digital Gallery or direct delivery method confirmed at booking. Raw, unedited event media will be retained by the Company for up to 30 days after the event and deleted thereafter.

By booking, the Client grants the Company permission to use event media (photos, videos, clips) for marketing, promotional, and social media purposes unless a written opt-out request is submitted prior to the event date to info@divine-360.com.

The Company is not responsible for content captured by guests on personal devices. Videos shared via QR code or AirDrop at the event are the responsibility of individual guests once delivered.
